Major Road Rule Changes Come Into Force Next Month — Are You Prepared?

One of the most significant moves is the enhancement of mobile phone detection. This will be powered by a new generation of AI-assisted surveillance cameras. These sophisticated cameras will be able to identify drivers who are using, holding, or touching their phone, even if they’re stopped at a set of lights.

The penalties for using your phone while driving will be tough: fines of up to $1,209 and up to five demerit points. This reflects a growing concern for road safety. “We know driver distraction is a major contributor to accidents and injuries on our roads”, says Nichole Orr, Principal Lawyer at Orr Legal. “These penalties reflect how seriously the community and the law are addressing this danger.”

Furthermore, new speed limit reductions will be implemented across many states following a rise in road deaths. Police will be closely monitoring speed and seatbelt compliance. Penalties for not wearing a seatbelt will increase, and the new camera technology will aid in detecting these offences, adding additional penalties where applicable.

The numbers are sobering: 15% of road fatalities in NSW involved a person not wearing their seatbelt. Between 2019 and 2023, 150 people died under these avoidable circumstances, according to the NSW government. “Safety is everyone’s responsibility on the road”, Nichole Orr adds. “This legislation aims to protect not just the driver, but their passengers and other road users as well.”

Lastly, ticketless parking fines — a policy implemented during the COVID-19 pandemic — are set to be abolished after numerous complaints from the community about unfair penalties. This signals a return to more traditional methods of issuing parking infringements.
